Terms of Service

These Terms of Service ("Terms") govern your use of Pixel Crawlers ("the Service"), operated by Brightwing Systems, LLC ("we", "us", or "our") and available at pixelcrawlers.com. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. By creating an account, you confirm that you are at least 13 years old. If you are between 13 and 18, you confirm you have your parent or legal guardian's permission to use the Service. We may require you to verify your age at registration.
2. Service Description
Pixel Crawlers is a free, browser-native rebuild of Shattered Pixel Dungeon by Evan Debenham, itself a port of Pixel Dungeon by Watabou. The Service lets you play single-player and multi-player runs of the game, submit runs to daily- and weekly-seed leaderboards, and create or play community-authored Episodes. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We do not guarantee any specific uptime percentage or level of availability.
3. Open Source & Upstream Attribution
The Pixel Crawlers source code is released under the GNU General Public License v3.0, the same license as its upstream works. Nothing in these Terms restricts the rights granted to you by the GPL-3.0 with respect to the source code.
Pixel Crawlers is an independent community project. It is not affiliated with, endorsed by, or sponsored by Evan Debenham, Watabou, or the Shattered Pixel Dungeon or Pixel Dungeon projects. Please support the original creators by playing and purchasing the official Shattered Pixel Dungeon on the platforms it is sold on.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information.
- Notify us immediately of any unauthorized use of your account.
- Not share your account credentials with others or create accounts on behalf of others without authorization.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service, including its WebSocket gameplay channels.
- Upload or transmit viruses, malware, or other harmful code designed to damage the Service or its infrastructure.
- Use the Service to harass, threaten, defame, or impersonate others, including via your chosen display name or any chat or lobby interactions.
- Submit manipulated, tampered, or programmatically generated runs to leaderboards; exploit bugs or unintended behavior to gain leaderboard standing; or otherwise cheat or defraud the ranking system.
- Use Episodes or any other authoring feature to publish content that infringes intellectual property rights, is obscene, harasses identifiable people, or violates applicable law.
6. API and WebSocket Usage
The Service exposes an HTTP API and WebSocket endpoints to power the gameplay client. By using these endpoints, you agree to:
- Use only the official Pixel Crawlers endpoints for automated or programmatic access.
- Not exceed reasonable usage limits; we reserve the right to throttle or block requests that constitute abuse or place excessive load on the Service.
- Not scrape, crawl, or use automated means to access the Service outside of those official endpoints.
- Accept that the API and WebSocket availability is provided on the same "as is" basis as the rest of the Service.
7. Your Content
You retain ownership of the runs you record, the Episodes you author, and any other content you submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit Your Content as necessary to operate the Service — including displaying Episodes and leaderboard runs to other players. You are solely responsible for Your Content, including ensuring it does not violate any laws or third-party rights.
We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be harmful or inappropriate. See our Privacy Policy for more details on data handling.
8. Copyright and DMCA
We respect the intellectual property rights of others. If you believe that content hosted on the Service infringes your copyright, you may submit a takedown notice to our designated agent at pixelcrawlers@brightwingsystems.com with the following information:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material on the Service that you claim is infringing, with enough detail for us to locate it (e.g., the Episode URL or leaderboard entry).
- Your contact information (name, address, email, phone number).
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
We will respond to valid takedown notices and may remove or disable access to the allegedly infringing content. Repeat infringers may have their access to the Service terminated.
9. Intellectual Property
The Pixel Crawlers source code is licensed under the GPL-3.0. The Pixel Crawlers name, logo, and pixelcrawlers.com branding are owned by Brightwing Systems, LLC and are not licensed under the GPL; you may not use them in a way that suggests endorsement of or affiliation with your own service without our written permission. The Pixel Dungeon and Shattered Pixel Dungeon names and art assets are the property of their respective creators and are used here under the terms of the GPL-3.0.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE PRESERVATION OR ACCURACY OF GAME SESSION DATA, LEADERBOARD STANDINGS, OR ANY USER-SUBMITTED EPISODE.
No advice or information, whether oral or written, obtained from Brightwing Systems, LLC or through the Service shall create any warranty not expressly stated in these Terms.
11. Limitation of Liability
11.1 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTWING SYSTEMS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THIS INCLUDES DAMAGES RESULTING FROM: UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; CONDUCT OF THIRD PARTIES, INCLUDING OTHER PLAYERS; LOST OR CORRUPTED GAME SESSIONS; OR THE LOSS OF LEADERBOARD STANDING.
11.2 Cap on Direct Liability
TO THE EXTENT BRIGHTWING SYSTEMS, LLC HAS ANY LIABILITY THAT CANNOT BE EXCLUDED, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $10.00.
11.3 Essential Basis
You acknowledge that the limitations and exclusions in this Section 11 are an essential element of the basis of the bargain between you and Brightwing Systems, LLC. Brightwing Systems, LLC would not provide the Service without these limitations.
12. Indemnification
You agree to indemnify, defend, and hold harmless Brightwing Systems, LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service or violation of these Terms.
- Any content you submit, including Episodes you author and runs you publish.
- Your violation of any third party's rights, including privacy, intellectual property, or contractual rights.
- Any claim that your conduct on the Service caused harm to other players.
13. Termination
We may suspend or terminate your access to the Service, or remove any submitted content, at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy. Brightwing Systems, LLC shall not be liable to you or any third party for any suspension, termination, or removal action taken in good faith pursuant to these Terms.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising out of or relating to these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in North Carolina. Judgment on the award may be entered in any court of competent jurisdiction.
14.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14.4 Jury Trial Waiver
TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO A JURY TRIAL IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS.
15. Children
The Service is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Brightwing Systems, LLC regarding the Service.
